This week, The Edwards Law firm announced they will be taking legal action against the Spotsylvania County school board. It specifically mentions members, Twigg, Gillespie, Abuismail, and Phelps. The lawsuit is being filed on behalf of 19-year-old, Makaila Keyes.
“The Edwards Law Firm PLLC has been retained to conduct an ongoing, independent legal investigation of the Spotsylvania County School Board regarding alleged violations of the Freedom of Information Act (FOIA), employment, and education law”
The letter begins. It goes on to allege that Kirk Twigg's communicating with the Board of Supervisors without public consent "violated Ms. Keyes' rights".
“Kirk Twigg willfully and knowingly violated Ms. Keyes’ rights when, against the warnings of certain colleagues, he chose to: (1) Propose, push, and pass a substantially and materially altered meeting agenda without an opportunity for public inspection“
It appears that the claims of Twigg's "corruption" have finally come to fruition in a legal case. Some, like the Spotsy Wire, have criticized the law firm's letter for being "political in nature" and full of logical errors.
Being that the case is largely about the Virginia FOIA "Freedom of Information Act", it seems Twigg's written information and emails have been released. The FOIA act states:
"The Virginia Freedom of Information Act (FOIA), located § 2.2-3700 et seq. of the Code of Virginia, guarantees citizens of the Commonwealth and representatives of the media access to public records held by public bodies, public officials, and public employees."
Documented email exchanges between Twigg and the BOS have been made public by multiple publications, including the Freelance Star. Twigg did not withhold any of the information obtained in the email, addressing it publicly during a February meeting.
The law firm calling this an "independent legal investigation", is at conflict with the fact that they filed the suit on behalf of the recent graduate of Courtland High, Makaila Keyes.
Many have dismissed this case as having no merit, and being politically charged with intent to recall a specific majority of the school board. The Edward's Law Firm said:
“A formal recall action will be pursued against any members whose conduct suggests neglect of duty, misuse of office, or incompetence in the performance of duties, such that the School Board’s duty to serve the best interests of the students and community has been materially compromised.“
This was very revealing of the goal of Makaila Keyes, and the suit being presented. A recall election would be very difficult to successfully happen however, as a successful recall hasn't happened since 2010 in the state of Virginia, as it requires substantial support and a judge's approval.
The lawsuit is was filed last Friday, and the hearing is expected to take place Friday, the 25th.
